 So DH and I have been separated for about 5 months now. I moved withour son back to our home state and filed for emer. custody and five months later we're finally establishing jurisdiction is in the state we were stationed in.... Ok, so now its time for court,
Facts:
He's non deployable and has that letter from unit to say so 
Hes a medicore dad who likes to drink and be a soldier more then a dad, but he puts on a great act for hte judge. 
Our home  of record is where we were married, my entire family lives, we lived prior to his enlistment, and our  child is enrolled in school here I work, I have an apt. and I'm doing very well for myself.  Church, volunteer, good community ties basically.  My son never goes to daycare like he would in Tx, etc. 
There is a Protection from Abuse order against him issued in the home of record state due to sexual emotional and minor physical violence. 
We own a home in the state he is serving in.
He says the PFA is invalid and should not have been issued that its a lie 
He also works shift work (7am to 7pm) 3-4 days a week as well as once a month staff duty ( 24 hours at a time) 


Given all the facts... whats your opinion?
I'm asking for the judge to allow me and my child to ocntinue living in our home or record and that my husband has partial custody (summer, holidays, etc.) but that he attend counseling to help wiuth the abuse. I DONT WANT MY CHILD getting hurt around him. HE has no family there. Other then our house... Its just him there.  I'm aware no one can give great answers, I guess I'm looking more for advice, your stories, anything to  help calm my nerves. I have never been away from my son for more then 3 days his entire life ( hes 4  years old!) and he can't even make it one night away from me with out major tears. There is no way he will be ok with his dad, who he hardly knows. 
Sad thing is there is no way to prove he is a bad dad really.... 

I just need to stop worrying, I know... but when there is a child involved who is your life.... Its so hard ;/ Thanks everyone for any info or help or advice. I really do appreciate it.
